Referral for an associates tribunal

We may refer a case to an associates tribunal, which will be run by the MPTS. This could happen where a PA or AA does not agree to the proposed outcome, or where a tribunal is needed to decide what action should be taken.

The MPTS operates a public hearing service and their decisions are fully independent of our investigations. An associates tribunal hearing can:

  • take no action
  • put conditions on the PA or AA’s registration, which restricts what they are allowed to do
  • stop a PA or AA from working for a set period of time (suspension)
  • remove the PA or AA from our register to stop them practising (removal).

If a tribunal hearing finds a PA or AA is not impaired, it may still issue a warning if there has been a clear and specific departure from the standards expected.
