On 18 September 2023 Dr Khan carried out a home visit which was, unnecessary, not requested, and not clinically indicated. During the home visit Dr Khan carried out an examination of the patient which was not clinically appropriate or necessary to be carried out in their home.
Between 8 December 2023 and 23 February 2024, Dr Khan inappropriately accessed a patient’s medical records on multiple occasions without documenting an appropriate reason for doing so.
This conduct does not meet with the standards required of a doctor. It risks undermining public protection, specifically patient safety, public confidence in the profession and professional standards and conduct and it must not be repeated. The required standards are set out in Good medical practice and associated guidance. In this case, paragraphs 1, 7, 16, 23, 69, and 81 of Good medical practice are particularly relevant:
1 You must be competent in all aspects of your work including, where applicable, formal leadership or management roles, research and teaching.
7g In providing clinical care you must consult colleagues or seek advice from your supervising clinician, where appropriate.
16 You must recognise and respect every patient’s dignity and right to privacy.
23 You must treat patients with kindness, courtesy and respect.
69 You must make sure that formal records of your work (including patients’ records) are clear, accurate, contemporaneous and legible.
81 You must make sure that your conduct justifies patients’ trust in you and the public’s trust in your profession.
Whilst this failing in itself is not so serious as to require any restriction on Dr Khan's registration, it is necessary in response to issue this formal warning.
