An audit of the confidential electronic patient record (the Record) of Baby A, an 11 month old patient who sadly passed away on 16 May 2023, showed that you had accessed the Record on a number of occasions between 17 May 2023 and 23 May 2023, when you had no legitimate reason to do so.
This conduct does not meet with the standards required of a doctor. It risks bringing the profession into disrepute and it must not be repeated. The required standards are set out in Good medical practice and associated guidance.
In this case, paragraphs 4 and 22 of Good medical practice and paragraph 120 of the GMC guidance, Confidentiality: good practice in handling patient information (2017), are particularly relevant:
Good medical practice (2024)
4 You must follow the law, our guidance on professional standards, and other regulations relevant to your work.
22 You must treat information about patients as confidential, including after a patient has died. You must follow our more detailed guidance on Confidentiality: good practice in handling patient information.
Confidentiality: good practice in handling patient information (2017)
120 You must not access a patient’s personal information unless you have a legitimate reason to view it.
Whilst this failing in itself is not so serious as to require any restriction on your registration, it is necessary in response to issue this formal warning.
This warning will be published on the medical register in line with our publication and disclosure policy, which can be found at www.gmc-uk.org/disclosurepolicy.
