On 28 March 2023 Dr Jain perforated a patient’s bladder when performing a transurethral resection of a bladder tumour using a resectoscope with which they were not familiar.
This conduct does not meet with the standards required of a doctor. It risks undermining public protection, specifically patient safety and public confidence in the profession and it must not be repeated. The required standards are set out in Good medical practice and associated guidance. In this case, paragraphs 1 and 2 of Good medical practice are particularly relevant:
1 You must be competent in all aspects of your work including, where applicable, formal leadership or management roles, research and teaching.
2 You must recognise and work within the limits of your competence. You must only practise under the level of supervision appropriate to your role, knowledge, skills and training, and the task you’re carrying out.
Whilst this failing in itself is not so serious as to require any restriction on their registration, it is necessary in response to issue this formal warning.
This warning will be published on the medical register in line with our publication and disclosure policy, which can be found at www.gmc-uk.org/disclosurepolicy.
