For over 25 years Dr Khan treated family members as their GP; one family was particularly vulnerable. This precluded them obtaining objective assessments, advice and treatment from a GP independent of the family.
His record keeping was inadequate and/or some of his assessments, treatment justifications and safety netting advice were omitted or not recorded which would have hampered any healthcare provision independent of him.
This conduct does not meet with the standards required of a doctor. It risks undermining public protection, specifically [patient safety/public confidence in the profession/professional standards and conduct] and it must not be repeated. The required standards are set out in Good medical practice and associated guidance. In this case, the following paragraphs of Good medical practice are particularly relevant:
3 Dr Khan must keep up to date with guidelines and developments that affect his work.
4 Dr Khan must follow the law, our guidance on professional standards, and other regulations relevant to his work.
26 He must be aware of his legal and ethical duties relating to consent and capacity. This means he must:
a be aware of the relevant law on capacity and mental health
b have regard to relevant codes of practice
c follow our guidance on Decision making and consent.
69 Dr Khan must make sure that formal records of your work (including patients’ records) are clear, accurate, contemporaneous6 and legible.
70 He should take a proportionate approach to the level of detail but patients’ records should usually include:
a relevant clinical findings
b drugs, investigations or treatments proposed, provided or prescribed
c the information shared with patients
d concerns or preferences expressed by the patient that might be relevant to their ongoing care, and whether these were addressed
e information about any reasonable adjustments and communication support preferences
f decisions made, actions agreed (including decisions to take no action) and when/whether decisions should be reviewed
g who is creating the record and when.
81 Dr Khan must make sure that your conduct justifies patients’ trust in you and the public’s trust in your profession.
97 He must, wherever possible, avoid providing medical care to himself or anyone with whom he has a close personal relationship. He must follow our more detailed guidance on Good practice in prescribing and managing medicines and devices.
Whilst this failing in itself is not so serious as to require any restriction on your registration, it is necessary in response to issue this formal warning.
This warning will be published on the medical register in line with our publication and disclosure policy, which can be found at www.gmc-uk.org/disclosurepolicy
