Warnings are issued to indicate when a registrant's behaviour or performance is significantly below the standards expected, but when restricting a registrant's practice is not necessary. See more on warnings.

On numerous occasions between March 2010 and July 2024, Dr Gupta prescribed for someone with whom he had a close personal relationship in circumstances where such prescribing had been avoidable.
This conduct does not meet with the standards required of a doctor. It risks bringing the profession into disrepute and it must not be repeated. The required standards are set out in Good medical practice and associated guidance.
In this case, paragraphs 4 and 97 of Good medical practice and paragraphs 66 and 68 of the GMC guidance, Good practice in proposing, prescribing, providing and managing medicines and devices are particularly relevant:
Good medical practice
4 Dr Gupta must follow the law, our guidance on professional standards, and other regulations relevant to his work.
97 Dr Gupta must, wherever possible, avoid providing medical care to himself or anyone with whom they have a close personal relationship. Dr Gupta must follow our more detailed guidance on Good practice in proposing, prescribing, providing and managing medicines and devices.
Good practice in proposing, prescribing, providing and managing medicines and devices
66. Wherever possible, Dr Gupta must avoid prescribing for himself or anyone they have a close personal relationship with.
68. Dr Gupta must not prescribe controlled drugs for himself or someone close to him unless:
a. no other person with the legal right to prescribe is available to assess and prescribe without a delay
b. emergency treatment is immediately necessary to avoid serious deterioration in health or serious harm.
Whilst this failing in itself is not so serious as to require any restriction on their registration, it is necessary in response to issue this formal warning.
