What is Permission to Appeal?

When you serve notice of appeal, the GMC is obliged under the The Anaesthesia Associates and Physician Associates Order 2024 to revise the decision being appealed, or to grant or refuse permission to appeal before the appeal process can proceed.

Permission to appeal means that your appeal will progress through the appeal process. Refusal of permission means your appeal will end and your fee refunded, minus the appeal assessment fee.

The GMC will grant permission to appeal if there is a real prospect of success.

What is a real prospect of success?

Real prospect means a realistic as opposed to fanciful prospect of success. It does not mean that the appeal would be more likely than not to succeed.
