Independent review of gross negligence manslaughter and culpable homicide

Leslie Hamilton and his working group have published their independent review into how the laws on gross negligence manslaughter and culpable homicide are applied to medical practice. The working group’s final report includes 29 recommendations for us and a range of organisations across the UK, covering local, coronial, criminal and regulatory processes.

Report of the task and finish group in Scotland

The law in Scotland relating to culpable homicide is different from the law on gross negligence manslaughter, which applies in the rest of the UK. A separate Scotland task and finish group was set up to advise the main working group on the issues as they applied in the Scottish legal and healthcare context. In addition, specific workshops and oral evidence sessions were held in Scotland to seek views from a range of stakeholders.

The Scotland task and finish group’s report has fed into the main review.
