GMC response to the Appeal Court ruling in the case of Dr David Southall

As well as taking immediate action to resolve this case, we are also determined to address the wider issues.

Niall Dickson, Chief Executive of the General Medical Council said:

"Although the case has been remitted back to the original panel, it is clear that the Court has overruled the panel's finding in relation to Mrs M. We accept that and will take immediate steps to resolve the outstanding issues raised in the judgement. This is a complex judgement and we will need to study the details before making any further comments.

"As well as taking immediate action to resolve this case, we are also determined to address the wider issues. In spite of the fact that it is rare for paediatricians involved in child protection to find themselves facing action by the GMC, there is no doubt that this case has caused considerable concern within the paediatric community. This is vital and difficult work and nothing should deter professionals from undertaking it, to protect vulnerable children across the UK.

"Accordingly, we will convene an expert group to review the guidance for paediatricians involved in child protection to ensure we can provide clarity and reassurance about what is expected from those who practise in this critically important area of healthcare.

"Further details of the review including membership of the group will be announced shortly."
