The Panel will inquire into the allegation that during 2010, whilst working as Honorary Consultant Physician at The University Hospital of Leicester NHS Trust, Dr Iain Stephenson altered and falsified information regarding his work as co-investigator in the study ‘Evaluation of heterosubtypic immune responses in older people before and after seasonal and pandemic influenza vaccination, an open label study (UHL 105418)’.

It is also alleged that Dr Stephenson forged the signatures of colleagues on a number of occasions.

The Fitness to Practise Panel will meet at St James’s Buildings, 79 Oxford Street, Manchester, M1 6FQ to consider a new case of impairment by reason of misconduct.

The Panel will inquire into the allegation that between June 2003 and July 2006 Dr Barclay intimately touched and digitally penetrated a patient, for non-clinical purposes, and also telephoned and visited the patient’s home for non-clinical purposes.

It is also alleged that Dr Barclay intimately penetrated and attempted to intimately penetrate the patient with his penis.

It is further alleged that Dr Barclay threatened to withhold a prescription for medication unless the patient complied with his intimate touching.

It is also alleged that in February 2006 Dr Barclay intimately touched and digitally penetrated another patient for non-clinical purposes.

It is alleged that Dr Barclay’s actions were sexually motivated and constituted an abuse of his professional position.

Dr Subramaniam YOGADEVA

The Fitness to Practise Panel will meet at St James’s Buildings, 79 Oxford Street, Manchester, M1 6FQ to consider a new case of impairment by reason of misconduct and deficient professional performance.

The Panel will inquire into the allegation that between 2007 and 2008 Dr Yogadeva told a member of staff to alter information on a number of General Practice Assessment Questionnaires, and also to only pass them to identified patients for completion.

It is also alleged that contrary to a Service Level Agreement made with Tower Hamlets PCT, Dr Yogadeva told staff not to book extended hours appointments, did not provide adequate consultations and that payment was claimed from the PCT for extended hours sessions that did not take place. Dr Yogadeva is also alleged to have purchased equipment under the Prescribing Incentive Scheme, which was not used in the Surgery. Dr Yogadeva is also alleged to have not complied with fire safety regulations at the surgery between 2006 and 2009.

Dr Yogadeva is further alleged to have been reluctant to undertake home visits on two occasions in 2008.

It is also alleged that following a conversation with a Community Palliative Care Nurse who visited the Surgery, the doctor is alleged to have refused to visit an unwell patient, despite being told that the patient may die.

It is also alleged Dr Yogadeva behaved inappropriately towards an employee at the Surgery and was allegedly rude towards a nurse at Mile End Hospital.

It is further alleged that following a GMC performance assessment Dr Yogadeva’s performance was found to be unacceptable in a number of areas, and a cause for concern in one area of Good Medical Practice.

The Panel will inquire into the allegation that between 2008 and 2009 Dr Mainds failed to provide good clinical care to a number of patients. It is alleged that he did not keep clear, accurate, and/or legible records in relation to patient care.

It is further alleged that Dr Mainds did not provide patients with clear or sufficient information relating to their conditions, diagnosis, prognosis and risks and results of proposed treatment, in order for them to make informed decisions.

Dr Mainds is also alleged to have not carried out adequate and/or appropriate pre-operative investigations or reviews of the appropriateness of surgery on a number of patients. Furthermore, it is alleged that he carried out inappropriate surgery.

It is further alleged that Dr Mainds did not ensure adequate post-operative care and/or act appropriately upon operative and post operative difficulties, and subsequently did not provide full and prompt explanations about those difficulties to some of the patients involved.

The Panel will inquire into the allegation that, whilst Dr Finella Brito-Babapulle was on certificated sick leave from Ealing Hospital NHS Trust and was receiving payment in line with the Trust’s sickness absence policy, she undertook private practice on dates between 1 October 2007 and 14 December 2007, and/or 2 March 2009 and 19 May 2009. It is alleged that Dr Brito-Babapulle’s actions in this regard were inappropriate and dishonest.

The Fitness to Practise Panel will meet at St James’s Buildings, 79 Oxford Street, Manchester, M1 6FQ to consider a new case of impairment by reason of misconduct.

The Panel will inquire into the allegation that whilst working as a Trust Grade doctor at the A&E Department of the Royal Victoria Hospital, Blackpool, during April to December 2010, Dr Koppad told a colleague that a Patient had chronic alcoholic seizures, and had been treated with lorazepam, which he knew was inaccurate. He is alleged to have recorded this in the patient’s medical records.

It is also alleged that Dr Koppad fabricated urinalysis test results in respect of a further patient, which he then passed the details of to a colleague and recorded the results in the patient’s medical records. Dr Koppad is alleged to have also told a senior colleague that he had been given these results by a third party when he knew that he had not.

It is further alleged that before a Trust Disciplinary Hearing, Dr Koppad stated that he had entered the results by mistake, having confused Patient B’s patient record with those of another patient.

His actions in respect of both patients are alleged to be misleading and dishonest.

The Panel will inquire into the allegation that in January 2009, while working on a London Deanery training programme, Dr Abu-Asi failed to disclose to the Deanery that he had previously received a police caution in August 2008 and a GMC warning on 26 January 2009, for failing to inform the GMC of the caution. It is alleged that in an application for a training post, Dr Abu-Asi did not disclose this caution or warning and in a CRB application, he did not disclose the caution.

It is alleged that at a meeting with the London Deanery, Dr Abu-Asi stated that he had sent an email to the Trust to correct this and maintained this position at a later meeting.

Dr Abu-Asi’s actions are alleged to have been dishonest and misleading.

The Panel will continue to inquire into the allegation that between June 2009 and February 2010, whilst working as an Orthopaedic Surgeon at the Spire Washington Hospital, Dr Fraser’s treatment of two patients, A and B, was inadequate.

It is alleged that the inadequate treatment included, variously, failings in relation to history taking, assessment, investigation, examination, note-keeping, consent, surgical technique and consulting with colleagues.

It is also alleged that on 29 January 2010, Dr Fraser performed a total right knee replacement on patient A which was not clinically justified.

The Panel will inquire into the allegation that an assessment of Dr Wamala’s professional performance, carried out on dates in November 2010 and January 2011, found his performance to be unacceptable in respect of providing or arranging treatment and relationships with patients. It is alleged that Dr Wamala’s professional performance was a cause for concern in respect of: record keeping; maintaining good medical practice; teaching, training, appraising and assessing; working with colleagues and other good clinical care. It is also alleged that Dr Wamala scored well below the minimal acceptable standard of 67% in the knowledge test.

It is further alleged that between 29 March 2010 and 12 April 2010, Dr Wamala submitted a written application for employment which contained dishonest declarations.

The Panel will inquire into the allegation that Dr Murugesu Vinayagamoorthy on 9 June 2009, was convicted at the Federal Courthouse in Brooklyn, New York of Conspiracy to Provide Material Support to a Designated Foreign Terrorist Organisation, an offence which if committed in England and Wales would have constituted a criminal offence. On 27 April 2011, it is alleged that Dr Vinayagamoorthy was sentenced to imprisonment for a period of time served, supervised release for a period of three years and a $100 special assessment.
