The Panel reviewed the order made on 17 March 2008 imposing conditions on Dr Robertson’s registration and directed that the conditions be maintained for the remainder of the duration of the order (until 16 September 2009). The conditions are as follows:

  1. He must notify the GMC promptly of any professional appointment he accepts for which registration with the GMC is required and provide the contact details of his employer.
  2. He must allow the GMC to exchange information with his employer or any organisation for which he provides medical services.
  3. He must inform the GMC of any formal disciplinary proceedings taken against him, from the date of this determination.
  4. He must inform the GMC if he applies for medical employment outside the UK.
    1. He must confine his medical practice to National Health Service posts where his work will be supervised by a named Consultant.
    2. He must seek a report from his supervisor for consideration by this Panel, prior to any review hearing of this Panel.
  5. He must not undertake private practice.
  6. He must not work as a locum or undertake any out-of-hours work or on-call duties.
  7. He must seek a report from the persons advising the GMC in relation to his fitness to practise, for consideration by this Panel, prior to any review hearing of this Panel.
  8. He must keep his professional commitments under review and limit his medical practice in accordance with the recommendations of the person(s) advising the GMC in relation to his fitness to practise.
  9. He must cease work immediately if the person(s) advising the GMC in relation to his fitness to practise recommend that he do so.
  10. He must not prescribe those drugs listed in Schedules 1 - 3 of the Misuse of Drugs Regulations 2001, as may be amended (from time to time).
  11. He must inform the following parties that his registration is subject to the conditions, listed at (1) to (11), above:
    • Any organisation or person employing or contracting with him to undertake medical work
    • Any prospective employer (at the time of application).

The Panel reviewed the order of conditions made on 18 December 2006, varied on 6 June 2007, extended by the relevant court on 12 June 2008, and determined that it should be maintained for the remainder of the duration of the order (until 16 March 2009).

The conditions are as follows:

    1. Except in life threatening emergencies, he must undertake all consultations with female patients with a chaperone present. The chaperone must be a fully registered medical practitioner or fully registered nurse.
    2. He must maintain a log detailing every case where he has undertaken a consultation with a female patient, which must be signed by the chaperone.
    3. He must maintain a log detailing every case where he has undertaken a consultation with a female patient in a life-threatening emergency, without a chaperone present.
    4. He must provide a copy of these logs to the GMC prior to any review hearing of this Panel or, alternatively, confirm that there have been no such cases during that period.
  1. He must notify the GMC promptly of any application for inclusion on a Medical Performers List. 
  2. He must notify the GMC promptly of any professional appointment he accepts for which registration with the GMC is required and provide the contact details of his employer.

The Panel reviewed the order of conditions made on 27 April 2007 and varied on 20 February 2008, and determined that it should be maintained for the remainder of the duration of the order (until 26 October 2008).

The Panel further directed the Registrar of the GMC that an application should be made to the relevant Court for an extension of the interim order under Section 41A (6) of the Medical Act 1983, as amended.

The conditions are as follows:

  1. He must notify the GMC promptly of any professional appointment he accepts for which registration with the GMC is required and provide the contact details of his employer and PCT on whose Medical Performers List he is included.
  2. He must allow the GMC to exchange information with his employer or any organisation for which he provides medical services.
  3. He must inform the GMC of any formal disciplinary proceedings taken against him, from the date of this determination.
  4. He must inform the GMC if he applies for medical employment outside the UK.
  5. He must not work as a GP Principal.
  6. He must not undertake any locum posts.
  7. He must not undertake any out-of-hours work or on-call duties for an out of hours or deputising service.
  8. He must not carry out any private practice work.
  9. He must confine his medical practice to a period of clinical retraining in the UK for at least one year.  This should be at the level of a GP registrar in a group practice approved by the Deanery and consisting of a minimum of three partners who should all be in good standing with the GMC.
  10. He should have a named workplace supervisor who should oversee his clinical retraining and continuing medical education.
    1. He should develop a clinical education plan for a period of 12 months, under the advice of his supervisor, which should be approved by the Deanery. This plan should address the deficiencies identified by the performance assessment team.
    2. He should submit a report every four months from his supervisor to the GMC, and a final report should be submitted at the end of the 12 months retraining period.
  11. He must inform the following parties that his registration is subject to the conditions, listed at (1) to (11), above:
    • Any organisation or person employing or contracting with him to undertake medical work
    • The PCT in whose Medical Performers List he is included or seeking inclusion (at the time of application).”
