The Panel considered the case of Dr Leopold and determined to impose an order of conditions on her registration for a period of 18 months (until 14 February 2010).  The conditions are as follows:

  1. She must notify the GMC promptly of any professional appointment she accepts for which registration with the GMC is required and provide the contact details of her employer.
  2. She must allow the GMC to exchange information with her employer or any organisation for which she provides medical services.
  3. She must inform the GMC of any formal disciplinary proceedings taken against her, from the date of this determination.
  4. She must inform the GMC if she applies for medical employment outside the UK.
    1. She must confine her medical practice to NHS F1 training posts under the supervision of a named Consultants(s).
    2. She must seek a report from her supervisor for consideration by this Panel, prior to any review hearing of this Panel.
  5. She must not prescribe for herself or a member of your family.
  6. She must seek a report from the persons advising the GMC in relation   to her fitness to practise, for consideration by this Panel, prior to any review    hearing of this Panel.
  7. She must keep her professional commitments under review and limit her medical practice in accordance with the recommendations of the person(s) advising the GMC in relation to her fitness to practise.
  8. She must cease work immediately if the person(s) advising the GMC in relation to her fitness to practise recommend that she does so.
  9. She must inform the following parties that her registration is subject to the conditions, listed at (1) to (9), above:
    • Any organisation or person employing or contracting with her to undertake medical work;
    • Any prospective employer (at the time of application).

  5. His practice shall be limited to Mental Health Act Assessments including Section 12 assessments under the Mental Health Act 1983

The Panel reviewed the order made on 13 April 2007 imposing conditions on Dr Bhatia’s registration and directed that the conditions be maintained for the remainder of the duration of the order until 12 October 2008.  The conditions are as follows:

  1. He must notify the GMC promptly of any professional appointment he accepts for which registration with the GMC is required and provide the contact details of his employer.
  2. He must allow the GMC to exchange information with his employer or any organisation for which he provide medical services.
  3. He must inform the GMC of any formal disciplinary proceedings taken against him, from the date of this determination.
  4. He must confine his medical practice to National Health Service substantive posts where his work will be supervised by a named Consultant.
  5. He must seek a report from his supervisor for consideration by this Panel, prior to any review hearing of this Panel.
  6. He must not work as a locum or undertake any out-of-hours work or on-call duties.
  7. He must inform the GMC if he applies for employment outside the UK.

As the order is due to expire on 12 October 2008 the Panel determined under rule 27(6) of the General Medical Council (Fitness to Practise) Rules, to direct the Registrar of the General Medical Council to make an application to the High Court for an extension of the interim order under section 41A(6) of the Medical Act 1983, as amended.
