The Panel determined that the order of conditions imposed on Dr Kiberu’s registration should be maintained, but the conditions should be varied for the remainder of the duration of the order (until 11 May 2009). The varied conditions are as follows:

  1. He must confine his medical practice to Histopathology posts within the National Health Service, save as provided for by the provisions of condition 6.

  2. He will not report on carcinomas, possible carcinomas or other malignancies, significant dysplasias and atypical naevi unless the Trust(s) can provide a second consultant opinion prior to the authorisation of such reports.
  3. He must maintain a log detailing every case detailed in condition 2, and the details of the log should be made available for future review hearings of the Interim Orders Panel.
  4. Following completion of reports by his Histopathology consultant colleagues in the fields listed in condition 2, he will provide a further second report. Dr Kiberu must maintain a log detailing every case which must be made available with the comparison report produced by his colleague(s). This log should also be made available to future hearings of the Interim Orders Panel.    
  5. He must not undertake any locum posts of less than three months duration.
  6. Notwithstanding the provisions of condition 1, he must not undertake any private clinical work with the exception of post mortem work.
  7. He must notify the GMC promptly of any professional appointment he accepts for which registration with the GMC is required and provide the contact details of his employer.
  8. He must allow the GMC to exchange information with his employer or any organisation for which he provides medical services.
  9. He must inform the GMC of any formal disciplinary proceedings taken against him, from the date of this determination.
  10. He must inform the GMC if he applies for medical employment outside the UK.
  11. He must inform the following parties that his registration is subject to the conditions, listed at (1) to (10), above:
    • Any organisation or person employing or contracting with him to undertake medical work.
    • Any locum agency or out-of-hours service he is registered with or applies to be registered with (at the time of application).
    • Any prospective employer (at the time of application).

  1. He must notify the GMC promptly of any professional appointment he accepts for which registration with the GMC is required and provide the contact details of his employer.
  2. He must allow the GMC to exchange information with his employer or any organisation for which he provides medical services.
  3. He must inform the GMC of any formal disciplinary proceedings taken against him, from the date of this determination.
  4. He must inform the GMC if he applies for medical employment outside the UK.
    1. He must confine his medical practice to National Health Service posts, where his work will be supervised by a named Consultant(s).
    2. He must seek a report from his supervisor(s) for consideration by this Panel, prior to any review hearing of this Panel.
  5. He must cease work immediately if the person(s) advising the GMC in relation to his fitness to practise recommend that he does so.
  6. He must inform the following parties that his registration is subject to the conditions, listed at (1) to (6), above:
    1. Any organisation or person employing or contracting with him to undertake medical work.
    2. Any locum agency or out-of-hours service he is registered with or applies to be registered with (at the time of application).
    3. Any prospective employer (at the time of application).
